Statement from New Mexico Hospital Association on House Judiciary Committee Advancement of HB 99

“On behalf of our 48 community hospital members, the New Mexico Hospital Association thanks the members of the House Judiciary Committee for their unanimous, bipartisan vote to advance the committee substitute for House Bill 99, Medical Malpractice Changes. We are especially grateful to Chairwoman Representative Christine Chandler, the bill’s sponsor, and co-sponsor Representative Gail Armstrong for their leadership in taking such a meaningful step toward protecting access to care for New Mexicans.

While our desire for a lower cap for punitive damages remains, we are hopeful that the changes to the Malpractice Act made in this substitute will advance long-term meaningful reform. HB 99 reflects an understanding that access to care in New Mexico depends on a fair and predictable medical liability framework – one that supports patients while allowing hospitals and physicians to continue providing care in their communities.

By reinforcing balance and stability, HB 99 helps retain physicians, particularly in rural and underserved areas, while preserving accountability and patients’ rights. The committee’s action today acknowledges the urgent need to address the liability pressures that are limiting access to care across the state.

We look forward to continuing to work with the Legislature to protect access to care for all New Mexicans through this meaningful reform.”
